Terms of Use

Important Disclaimer — Please Read
CalculateSettlement.com provides free informational estimates only. Nothing on this website constitutes legal advice, creates an attorney-client relationship, or predicts the outcome of any legal matter. Actual settlement amounts vary substantially based on jurisdiction, case facts, legal representation, judicial discretion, and many other factors. Always consult a licensed attorney in your state before making any legal decisions.
1. Acceptance of Terms
By accessing or using CalculateSettlement.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to all of these Terms, you must not use this Site. These Terms apply to all visitors and users in all 50 U.S. states and internationally.
2. Nature of the Service — Not Legal Advice
The calculators, estimates, content, explanations, and any PDF reports generated by this Site are provided for general informational and educational purposes only. They do not constitute:
- Legal advice under the laws of any jurisdiction
- An attorney-client relationship
- A guarantee, prediction, or warranty of any settlement outcome
- A substitute for consultation with a licensed attorney
- Tax advice (consult a qualified tax professional for tax implications)
Our calculations are based on general formulas, publicly available state-level data, and widely used industry methodologies. They do not account for the unique facts of your specific case, the negotiating positions of adverse parties, the preferences of individual judges, or recent changes in law that may not yet be reflected in our data.
You should not rely on information from this Site when deciding whether to accept or reject any settlement offer, sign any legal document, or take any action with legal consequences.
3. Accuracy and Timeliness of Information
While we make reasonable efforts to keep our state-specific data, benefit caps, multipliers, and formulas accurate and current, we make no warranty — express or implied — regarding the accuracy, completeness, currency, or reliability of any information on this Site. State laws and benefit caps change frequently. We recommend verifying all figures with official state agency sources or a licensed attorney before relying on them.
Errors, omissions, or outdated information may exist. Use of information from this Site is at your own risk.
4. Limitation of Liability
To the maximum extent permitted by applicable law, CalculateSettlement.com, its owners, operators, contributors, and affiliates shall not be liable for any:
- Direct, indirect, incidental, special, consequential, or punitive damages
- Loss of revenue, profits, business, data, or goodwill
- Damages arising from your reliance on any estimate, report, or information on this Site
- Damages arising from any legal decision you make based on information from this Site
This limitation applies regardless of the legal theory under which damages are sought and even if we have been advised of the possibility of such damages. Some states do not allow the exclusion or limitation of certain damages, so the above limitation may not apply to you.
5. Jurisdiction-Specific Disclaimers
Settlement law, alimony law, divorce property division, and workers compensation rules vary significantly by state. Our calculators are designed to provide general estimates and do not substitute for knowledge of your specific state's current statutes, case law, or administrative rules. The following specific disclaimers apply:
Workers Compensation
State workers comp systems differ dramatically in benefit caps, permanent disability schedules, and settlement procedures. Texas, for example, allows employers to opt out of the state workers comp system entirely. Oklahoma permits opt-out employers as well. In no-fault states, liability rules differ from tort states.
Personal Injury
Contributory negligence states (Alabama, Maryland, North Carolina, Virginia, and Washington D.C.) may bar recovery entirely if you bear any fault. Most states use comparative fault, but pure vs. modified comparative fault systems produce different results. Our calculator uses comparative fault assumptions.
Alimony / Spousal Support
Some states (Texas, Mississippi) rarely award permanent alimony. California, New York, and Massachusetts may award longer-duration support. Courts have broad discretion. The TCJA (2017) eliminated the alimony tax deduction for agreements executed after December 31, 2018.
Divorce / Property Division
Community property states (AZ, CA, ID, LA, NV, NM, TX, WA, WI) divide marital property 50/50 as a default. All other states apply equitable distribution, which is not necessarily equal. Separate property, prenuptial agreements, and fault (in some states) can significantly alter the outcome.

You waive any right to a jury trial and to participate in class-action litigation.
